I, , represent that I am the owner/lawful representative of the owner of any and all works of art that I list, now or in the future, on the digital platform Fineartdonations.com. By completing this consignment agreement, I am authorizing Fineartdonations.com to market any and all works of art that I may list, now or in the future, to its proprietary list of museum professionals and to include photos and descriptions of the work in the “Museum Member” section of its website. I understand that Fineartdonations.com will earn a fee for performing this service – That fee is $100 payable at the time the work is listed, and a percentage of the donation value upon the work being accepted into the collection of an accredited institution. The $100 listing fee is waived through June 30, 2024, and will resume on any and all new listings starting July 1, 2024. Currently, the percentage fee is 10%, of the appraised value of works valued up to $1,000,000 and 5% with respect to any sums above $1,000,000. In the case that the percentage fee of the donated artwork’s appraised value is not provided by the consignor, the name and contact of the interested institution will be withheld until payment is remitted.
I understand and agree that the fineartdonations.com fee will be fully earned once an accredited/nonprofit institution agrees to accept the offered artwork into its collection for a period exceeding 5 years.
I understand and agree that unless I pay an hourly fee for additional services provided by Fine Art Donations, I am solely responsible for communicating and working with the donee (museum) to facilitate the physical and legal transfer of the donated work of art into the museum collection once a work has been accepted, and the necessary paperwork affecting the donation are executed. Any special requests should be communicated directly to the museum.
I understand and agree that additional services provided by Fine Art Donations, such as locating an acceptable art transporter or conservator, will be billed at $250 an hour, but only upon special request of those services with advance approval. No additional fees will be incurred unless approved in writing by the consignor.
I understand that should I enter into a separate retainer with any professional recommended by Fineartdonations.com, I will be solely responsible for communication and payment of these outside professionals, unless agreed otherwise.
I agree to make available for donation, any and all listed works for at least six months from the day the donation listing is first approved, and if for any reason the work of art is sold, lost or donated elsewhere, I will be responsible for Fineartdonations.com's full fee based on the agreed schedule,, unless I replace the listing with a work of similar value for donation, and Fineartdonations.com agrees to that substitution.
I understand that from time to time, works that I may offer for donation to fineartdonations.com (or other works from my collection) may be sold directly as a result of the efforts of fineartdonations.com. Should that occur, I would need to approve the sale taking place in advance., I agree to pay J. Gold Fine Art, LLc. a commission of 15% of the selling price.
I agree that any dispute regarding this agreement will be venued in Nassau County, N.Y. and that I consent to the jurisdiction of any court located in Nassau County, N.Y., and that I will accept service of process by email and/or Federal Express. I further agree and acknowledge that J. Gold Fine Art, LLc’s and fineartdonations.com’s combined liability will be limited to any payments made by me to those entities under this agreement.
I authorize J. Gold Fine Art, LLc, the corporate owner of Fineartdonations.com to charge me $100 for any and all NEW artwork listings starting July 1, 2024 (listing fee waived for all listings submitted prior to this date), and to bill its full fee as set forth above, at the time the work is accepted by an accredited institution.
